Identity Systems International (Pvt) Ltd provides its Asset Registry, Monitoring & Tracking System, DETRACK, solely to give individuals, businesses and any organisation a secure way of protecting and disposing their property, through the use of a unique Mobile Application.
Identity Systems International (Pvt) Ltd grants you rights to make use of our exclusive application with an account and this account, including all its credentials and security information, should be used in confidence and not shared with another individual, unauthorized employees or anyone outside of your organization. By creating an Account on the registration page and by completing the registration process, You agree to be bound by all of the Terms and Conditions herein. As a self-service application, You alone understand, acknowledge and agree, that You:
- Are responsible for the contents of your account and device information.
- Will be expected to pay a Subscription fee for each device to enable specific functions which ensure that it is available and recognized by all tracking functions available in the system.
- Understand our service allows you to keep on your Asset/Devices register up to five Unsecured devices for a period of 90 days during which you have to pay the required subscription to secure them.
- Understand our Services are based on periodic subscription fees. Any devices not protected by payment of the relevant subscription within the 90-day period stated above will automatically be deleted from the Account and Database.
- Certify that contact details you enter or upload in your Account are correct. Plus, You are responsible for the accuracy of your devices information and the management of information relating to them.
- Will not use our service for fraudulent dealings, or commercial solicitations or to send any message or material that (a) is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive or illegal; (b) violates the property or any other rights of another party; or (c) otherwise gives rise to liability or violates any other applicable law. If we become aware of or determine, in our sole discretion, that you are violating any of our Terms of Use, we may modify or terminate your privileges, with or without notice to you.
- Will not hold liable Identity Systems International (Pvt) Ltd or its directors for the content of the messages or the sending of the messages to un-authorized users. We have the right at any time to suspend your account if we believe you are in breach of the terms and conditions accepted by you.
Usage and Monitoring
You may use the Mobile Applications or service only as intended by Identity Systems International (Pvt) Ltd. While Identity Systems International (Pvt) Ltd has no obligation to monitor the Mobile App and is not responsible for your conduct, Identity Systems International (Pvt) Ltd reserves the right to suspend, prohibit, deny access, edit, or take other appropriate action with respect to the Services it believes may be (or is alleged to be) in violation of the Terms of Use foregoing to anyone at anytime. All persons are hereby notified that use of the Mobile Application constitutes consent to such actions, monitoring and auditing.
Free Trial, Fees and Payment
If you used a free trial of the Mobile App, upon expiry of the demo period, You will be required to submit payment for Services unless you have already purchased subscription. Provided payment or means of payment is not received, all subscription driven services will be removed such as device protection during search enquiries. Security on devices will be unavailable until subscription payment is received.
Subscription Fees are based on prescribed term (period) rate and other associated Services you select. You are responsible for reviewing the Pricing Schedule from time to time and remaining aware of the Fees charged by Identity Systems International (Pvt) Ltd. The Pricing Schedule, including text messages fees, is subject to change at any time at Identity Systems International (Pvt) Ltd's discretion. Identity Systems International (Pvt) Ltd will notify you of any change to the Pricing Schedule when you are prompted to verify the amount payable, before you complete payments.
Payment for Services will be made through all payment methods available in your country through the Mobile App, or by cheque or bank electronic transfer for companies and organisations. Fees are payable in US dollars unless your local currency is available through the available local payment methods. If you have previously provided your credit card for payment, you hereby authorize Identity Systems International (Pvt) Ltd to charge your credit card for such amounts.
You acknowledge and agree that you are responsible for paying Fees for all text messages sent through to yourself and Identity Systems International (Pvt) Ltd under your account regardless of whether the message is received by our DETRACK system or prevented or possibly blocked by the Mobile Service Operator.
Additional service(s) from Identity Systems International (Pvt) Ltd are available and will be individually charged. We will not commence such service(s) until a confirmation of such is agreed in writing by You and Us and payment for the Services has been received.
Unavailability of Service
DETRACK may become unavailable due to numerous reasons such as to implement changes, upgrades and maintenance. We will use reasonable endeavors to perform the activities which require the unavailability of the services, or which are reasonably likely to have an adverse effect upon the services, between the hours of 0100hrs to 0500hrs Central African Time. In the case of un-planned maintenance, Identity Systems International (Pvt) Ltd shall provide as much advance notice to clients as is reasonably commercially practicable. Identity Systems International (Pvt) Ltd shall use its reasonable endeavors to conduct these activities under this paragraph to minimize adverse impact on clients.
Restrictions and Responsibilities
You are the sole proprietor and user of Your account and subscriber information. Identity Systems International (Pvt) Ltd will for no reason utilize the account or information for its own purposes or that of others, unless specified by You in writing or required by law. Identity Systems International (Pvt) Ltd ensures the data is protected through a secure username and password access point. Subscriber's personal data is encrypted when stored and for data protection an offsite back-up is created every 24 hours.
This is an Agreement for Services, and you are not granted a license to any part of the software by this Agreement. You will not, directly or indirectly: reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, patents, or algorithms of, or found at or through the Services or any software, documentation, or data related to the Services ("Software"); remove any proprietary notices or labels from the Services or any Software; modify, translate, or create derivative works based on the Services or any Software; or copy, distribute, pledge, assign, or otherwise transfer or encumber rights to the Services or any Software.
Unless you are authorized by Identity Systems International (Pvt) Ltd, you may not display, copy, reproduce, or distribute the Software, any component thereof, any documentation provided in connection with the Services or the Software, or any content, including but not limited to newsletters, distributed to you by Identity Systems International (Pvt) Ltd in connection with the Services. Violation of these restrictions may result in the termination of this Agreement and legal action.
You acknowledge and agree that the Services and the Identity Systems International (Pvt) Ltd company names and logos and all related product and service names, design marks and slogans, are the property of Identity Systems International (Pvt) Ltd or its affiliates or suppliers. You are not authorized to use any of the Names and Logos in any advertising, publicity or any other commercial manner without the prior written consent of Identity Systems International (Pvt) Ltd. Your use of the Services confers no title or ownership in the Services, the Software or the Names and Logos and is not a sale of any rights in the Services, the Software or the Names and Logos.
The Services may only be used for lawful purposes. Transmission or solicitation of any material that violates the Code of Conduct, the Zimbabwe national or other laws that may apply in this jurisdiction or your local area is prohibited. If you receive special discounts, Identity Systems International (Pvt) Ltd reserves the right to change those discounts at anytime. In the case of any change in status, discounts may no longer apply.
